USAGE AGREEMENT ( www.igoc.in )
Definitions:
IOPEPC: Indian Oilseeds & Produce Export Promotion Council (IOPEPC) having its office at 78/79, Bajaj Bhavan, Nariman Point, Mumbai – 400021, Maharashtra, India
IGOC: IOPEPC Global Oilseed Conference (IGOC) organised by Indian Oilseeds & Produce Export Promotion Council (IOPEPC) to be held during 4th to 6th November, 2022 in Deira, Dubai.
IGOC website: IOPEPC Portal (www. http://igoc.in) for registration and payment to participate in IOPEPC Global Oilseed Conference (IGOC). .
Registrant: Any person registering and making payment to participate in IOPEPC Global Oilseed Conference (IGOC).
IOPEPC Arbitration Rules: The Arbitration Rules of Indian Oilseeds & Produce Export Promotion Council For Local and International Contracts, provided on www.iopepc.org.
1. Terms & Conditions
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE REGISTERING AND PAYING TO PARTICIPATE IN IGOC ON THIS WEBSITE (HEREIN AFTER REFERRED AS Site)
BY USING THE SITE OR BY USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS SET FORTH BELOW INCLUDING ANY ADDITIONAL GUIDELINES AND FUTURE MODIFICATIONS THAT WE IMPLEMENT FROM TIME TO TIME. IF AT ANY TIME YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS OR DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY REFRAIN FROM USING THE SITE AND IMMEDIATELY TERMINATE YOUR USE OF THE SERVICES.
The Terms and Conditions (as may be amended from time to time) is a legal contract and an agreement between you, an individual customer, member, user, or beneficiary of this service of at least 18 years of age ("You"), and IOPEPC, regarding Your use of Services on our website. IOPEPC reserves the right, at its sole discretion, to revise, add, or delete portions of these terms and conditions any time without further notice which shall be your responsibility to visit from time to time in order to stay abreast of any changes that the "Site" may introduce.
IOPEPC provides an online platform for registration to participate in IGOC. 100% amount needs to be paid for registration for issuance confirmation to participate in this event.
The details of permitted check-in and check-out time are provided on this website. Any change in the itinerary /programme/venue will be communicated by IOPEPC.
All the communications post registration must be recorded in writing between client and IOPEPC. Any other form of communication regarding changes will not be entertained in cases of dispute.
2. Jurisdiction
Any/All disputes, Complaints, Recovery of Damages pertaining to this Usage agreement are required to be referred to Arbitration Panel of IOPEPC, to the exclusion of all other jurisdictions in India or abroad. Thus, this Usage Agreement is "Subject to IOPEPC Arbitration Jurisdiction Only". The Rules of Arbitration under IOPEPC are available on the website of IOPEPC viz. www.iopepc.org.
3. Transacting on the Portal
The IOPEPC Portal provides an electronic registration to participate in IGOC. The specific details of IGOC are provided on IGOC website. By transacting on the Portal, it is agreed that you have read all the details, terms & conditions for participation in IGOC and are satisfied in all aspects.
By transacting on this Portal, you are accepting this Usage Agreement.
The applicable payment to be paid by you will include cost of Registration and Convenience Charges as displayed on the IGOC website. By agreeing to pay, you accept that the payment of Convenience Charges (in addition to Registration Cost) to be borne by you.
4. Good Faith and Fair Dealing
Each registrant hereby agrees to act in accordance with the principles of good faith and fair dealing when transacting on or through the Portal. The IOPEPC reserves the right to investigate any allegation or evidence of any Registrant’s failure to abide by the principles of good faith and fair dealing in connection with its use of the Portal, and to fashion and enforce remedies, in its sole but reasonable discretion, in order to address any violation of such principles.
5. Statute of Limitations
Each registrant agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the IGOC website or these Terms and Conditions must be filed within one (1) month after such claim or cause of action arose or be forever barred.
6. Arbitration and Interim Relief
Any controversy or claim arising out of or relating to the Terms and Conditions, including, without limitation, this Usage Agreement, shall be settled by binding arbitration, by arbitrator(s) by IOPEPC, in accordance with “The Arbitration Rules Of Indian Oilseeds & Produce Export Promotion Council For Local and International Contracts”, provided on www.iopepc.org
Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Mumbai, and judgment on the arbitration award may be entered into the Bombay High Court having jurisdiction thereof. The registrant will not seek any interim or preliminary relief, from any other court. The fees of the arbitrator shall be borne as per the IOPEPC Arbitration Rules.
7. Governing law and jurisdiction
This Usage Agreement and the relationship between any registrant and the IOPEPC, shall be governed by and construed in accordance with the IOPEPC Arbitration Rules, laws of India and the Bombay High Court shall have exclusive jurisdiction without regard to conflict of law provisions. Those who choose to access this Portal from other locations do so on their own initiative and are responsible for compliance with local laws.
8. Limitation of Liability and Damages
IN NO EVENT WILL IOPEPC OR ITS EMPLOYEES, DIRECTORS, CONTRACTORS, AGENTS, LICENSORS, PARTNERS, OR SUPPLIERS BE LIABLE TO YOU FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, RELIANCE, OR EXEMPLARY DAMAGES (INCLUDING WITHOUT LIMITATION LOST BUSINESS OPPORTUNITIES, LOST REVENUES, OR LOSS OF ANTICIPATED PROFITS OR ANY OTHER PECUNIARY OR NON-PECUNIARY LOSS OR DAMAGE OF ANY NATURE WHATSOEVER) ARISING OUT OF OR RELATING TO REGISTRATION AND PAYMENT ON THE SITE.
In no event will IOPEPC or any of its contractors, directors, employees, agents, third party partners, licensors or suppliers' total liability to You for all damages, liabilities, losses, and causes of action arising out of or relating to registration and payment as per (i) this Agreement, (ii) the Services, (iii) Your use or inability to use the Services or the Site or (iv) any other interactions with IOPEPC, however caused and whether arising in contract, tort including negligence, warranty or otherwise, exceed the amount paid by You, if any, for registration and payment or Services on the Site giving rise to the cause of action or One Thousand Rupees (Rs.1000), whichever is less.
9. Indemnification
You agree to indemnify, save, and hold IOPEPC, its affiliates, contractors, employees, officers, directors, agents and its third party suppliers, licensors, and partners harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to Your use or misuse of the Services or of the Site, any violation by You of this Agreement, or any breach of the representations, warranties, and covenants made by You herein.
10. Refund and Cancellation
In case of non-compliance of payment terms, IOPEPC reserves the right to cancel the registration at any point of time without any refund.
No refund would be applicable under any circumstances, except in case of cancellation of the event by IOPEPC.
If due to unforeseen circumstances, IOPEPC has to cancel IGOC event, full amount paid by the registrant will be refunded. The refund will be credited back to the same account from where the payment was made.
In case you are not able to participate in IGOC event, no refund will be given under any circumstances except in case of cancellation of the event by IOPEPC.
It is mandatory to carry original valid photo identity card (Passport /Driving License) while attending the IGOC event.
